THRPY In BLK Wellness Collective: Legal & Privacy Notice

I. LEGAL DISCLAIMER

THRPY IN BLK Wellness Collective (the “Collective”) is a directory and administrative support network for independent mental health professionals. By accessing this site or engaging with our members, you agree to the following:

  • Independent Practices: Every member of the Collective operates as a completely separate and independent business. This Collective is not a partnership, joint venture, or group practice.

  • No Joint Liability: Each therapist is solely responsible for their own clinical services, medical records, and professional conduct. No member of the Collective is liable for the practices of another member. Your therapeutic relationship is strictly and exclusively with your chosen Independent Practice.

  • Directory Purpose: This platform serves as a directory to help you find and connect with independent, vetted therapists who primarily focus on the unique mental health needs for Black people and other people of the global majority. It does not provide clinical services.

  • Information Only: This website is for informational and marketing purposes. Listing a practitioner on this site does not constitute an endorsement of clinical outcomes.

II. NOTICE OF PRIVACY PRACTICES (NPP)

1. Data Ownership

THIS NOTICE DESCRIBES HOW YOUR Personally Identifiable Information (PII) AND Protected Health Information (PHI) ARE HANDLED, AND HOW YOU CAN GET ACCESS TO THIS INFORMATION. PLEASE REVIEW IT CAREFULLY.

All Protected Health Information (PHI) and Personally Identifiable Information (PII) are owned, managed, and maintained exclusively by your specific therapist’s Independent Practice. The Collective does not store or access your clinical records.

2. Limited Administrative Handling

The Collective will only handle your PII (such as name, contact info, or billing data) for administrative tasks (e.g., matching you with a therapist or processing a payment) and not for clinical services. This handling occurs only:

  1. As requested by the Independent Practices to perform specific administrative duties; and

  2. With your express written consent, which may be obtained by your therapist as part of their membership in the collective.

3. Privacy Safeguards

When performing authorized administrative tasks, the Collective acts only as a "Business Associate" to your therapist. We are contractually obligated to:

  • Use your information only for the specific administrative task you authorized.

  • Implement industry-standard security safeguards to protect your PII.

  • Never use your PII for clinical services, marketing, or any purpose outside of the administrative support you requested.

4. Your Rights

  • Revocation: You may revoke your consent for the Collective to handle your PII at any time by notifying your therapist in writing.

  • Access: To request copies of your clinical records or to discuss your privacy, please contact your therapist’s Independent Practice directly, as they are the sole custodian of your records.

  • Complaints: If you have concerns about how your data is handled, you may contact your therapist or the U.S. Department of Health and Human Services.
